In US law, a lis pendens is a written notice that a lawsuit has been filed concerning real estate, involving either the title to the property or a claimed ownership interest in it. The notice is usually filed in the county land records office. Recording a lis pendens against a piece of property alerts a potential purchaser or lender that the property’s title is in question, which makes the property less attractive to a buyer or lender. After the notice is filed, anyone who nevertheless purchases the land or property described in the notice takes subject to the ultimate decision of the lawsuit.

教训 1： Lawyer 是吃人的。 一定要防他们。
打了好多电话。 第一个Lawyer 自称当地 Lawyer 王。 一定搬我搞定。 先交 3 千大洋。 俺象找到救星， 3 千大洋马上供上。 开始盼他的好消息。 等了2 周， 没有回音。 跑到他的办公室， 他气粗的说， 已经和 City Attorney 联系。 City Attorney 还没有回他。又等了 2 周， 我又到他的办公室， 他说， City Attorney 还是不回他。 我要耐心等等。他再送一封信过去。 我问他有没有其它办法。 他说没有。 只有等。
我等不了啦。 我又开始找 Lawyer. 每问一个lawyer 都好像 干过和我相同的 case. 我的白玉房 是金库。 只要给钱， 包搞定。 但不多谈 strategy-。 交钱后再说。
我还敢再交钱吗？ 我跑到court. 东张西望的看，看到了在court 听 case 的几个实习生。俺是大学城。实习生 热情好学。 我问有没有和我一样的 case. 留了电话。不愧是名校学生， 没有多久 就告诉我如何把房收回的方法和步骤。 还给我讲了几个和政府占私人财产的 case. 我马上雇佣了他们推荐的 attorney。 而且按步骤收费。
1. 我不需要和政府lawyer 干。 我直奔 foreclosure 老总毒王. 那时， 俺胆小。 不敢想 我 individual 可以和bank 一样 做 foreclosure。 我想我应该和政府沟通。 首先去掉 Liz Pendens， 然后 再要求老总卖房。 把贷款追回。 俺雇的 职业 foreclosure Lawyer 说， foreclosure 不需要 管 Liz Pendens. 先把房变成钱。 要求把钱压在 court escrow. 到时候， City Attorney 就会出手了，找我们谈。 而且， 我还能拿回我该收有的贷款，和贷款有关的费用 (late fee, interest)和attorney 费。 如果官司打的长的话， 我们还可以要求要利息。
2. 俺的 attorney 开始了 foreclosure. Foreclosure letter sent out. 俺交了第一步骤的钱。 几百块。 过了一个多月， 俺又交了foreclosure 的publication 费。 又过了3个月， 毒老总的 Attorney和 City Attorney 给我的 Lawyer 回信了，毒老总的 Attorney 要求推后 foreclosure。他们正在和 City 谈条件。 City Attorney 不反对 foreclosure。 但proceeds 要求压在 escrow, 马上会叫judge 签字执行. 我看到 City Attorney 回信。 我胆大的打了一个电话给她。 她说 谢谢我foreclosure。 City 对房不感兴趣。 后来 我的 Lawyer 说， 我的 foreclosure 帮城里省了很多钱和事和时间。 要不他们还得花钱雇 人做。
3. 2 个月后， 房被拍了。 钱压在 escrow. 我前后给了我的attorney 2 千多块。
4. 没有多久，毒老总的attorney 和 City 谈成了条件。毒老总 还真厉害。 Liz Pendens 去掉了. 俺拿回来所用的钱。城里没收了他的所有的 财产和银行帐。 唯独还了他 俺的白玉房多余的proceeds。 俺原来是 准备打持久战。 俺的 Attorney说， 也许是 homestead status 帮了他。
教训 2： Always record your lien immediately no matter how busy you are. 俺幸运啊。 毒老总的 案件复杂。 花时间去判。 要不， 如果判案快， 俺的房会被判给政府。 政府的lien 先 登记了。 我死定了。 实习生告诉我， 小毒dealer 被抓到。 3， 5 天， 犯案的车和私人财产 就判了。 很快 就送去拍卖了。大家 永远不要把车给 teen 开。 俺知道有人的宝马被收了。 上高中的孩子超速， 被老警挡了。 发现后坐的同学带毒品吸。
教训- 3 学到的东西： 聪明人 如果现金买房，放一个 mortgage lien 在房上. 如果送pizza的人， 知道你有钱。 房子没有贷款。 故意贯一跤， 你也许会被恶惩。赔很多。用亲戚或者自己的公司放一个贷款在房子上， 保护自己的财产。
