08/28/2007: Misleading Statistics of Backlog of I-485 Applications

At the end of June 2007, the backlog of I-485 applications including EB and FB and other cases recorded 597,844. However, the official DHS sources indicate that the number of the I-485 applications was reduced to 493,356 at the end of July 2007. Close examination of these numbers would easily tell the public that the numbers do not represent reduction of the backlogs but rather reflect the fact that the receipting of July 2007 VB cases practically halted in July 2007. It has been widely reported by the immigrants and immigration lawyers including this reporter that July 2 I-485 receipt notices have yet to be receipted despite there were a few reports of issuance of such receipt notices about two weeks back. This also implies that some recent release of July 2007 VB I-485 numbers by some sources including New York Times and other sources may not reflect the actual numbers when the actual numbers are actually data-entried and tallied by the Service Centers. The numbers could be higher than the information that has been flying around. Please stay tuned.


08/28/2007: Mounting I-140 Backlog

The backlog of I-140 petitions is deteriorating rather than improving, probably affected by two factors, among others. One is suspension of I-140 PPS and the other is July 2007 VB filings. At the end of June 2007, the I-140 backlog reached 103,000 petitions. Now at the end of July 2007, it rised to 130,955. Considering the fact that July VB cases are still yet to be receipted, the actual number could have been much higher than this number, had the actual receipt cases in July been all counted. We have no information available about how the August filings would change the picture of I-140 backlogs. EB immigrants should be prepared for the anticipated delays in I-140 petitions and those who need the benefit from the approval of I-140 petitions which we explained earlier on this site may as well look for alternatives to deal with their problems relating to H-1B extensions beyond six years, AC 21 180-day employment change, etc. etc.
